Class Action

Manitoba introduced The Class Proceedings Act effective January 1, 2003. Class action legislation had previously been enacted in other Canadian provinces including Ontario, British Columbia and Quebec. Legislation in Manitoba is considered relatively plaintiff friendly and, as such, class proceedings are being commenced here which are proposed to be national in scope. In addition to significant financial exposure, there is often a public relations aspect to class proceedings more so than ordinary legal proceedings.

Aikins has developed knowledge and experience in both advancing and defending class actions. Our experience has involved a variety of proceedings including insurance, securities, taxation and product liability claims. The knowledge and resources of the Aikins firm make it the logical choice for both plaintiffs and defendants contemplating class action litigation in Manitoba. Aikins has the ability to draw on its experienced litigation counsel as well as on relationships that it has developed with class action counsel in other provinces. This allows Aikins to provide a coordinated approach in circumstances where parallel proceedings have been commenced in other jurisdictions.
